1. Introduction
These Terms of Service (“Terms”) govern your access to and use of www.nordicyarn.com (the “Site”) and any purchases you make through the Site. The Site is operated by Nordic Yarn USA LLC (“Nordic Yarn,” “we,” “us,” or “our”), a New Hampshire limited liability company based in the United States.
By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or make a purchase.
We reserve the right to update these Terms at any time. Changes take effect when posted to this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. Eligibility
By using the Site and placing orders, you represent that you are at least 16 years of age and have the legal capacity to enter into a binding agreement. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement and consent of a parent or legal guardian.
3. Products and Orders
Product descriptions
We make every effort to describe our products accurately, including fiber content, weight, yardage, and color. However, we cannot guarantee that your screen displays colors with perfect accuracy. Slight variations between skeins, particularly in hand-dyed or recycled fiber yarns, are inherent to the material and are not considered defects.
Pricing
All prices on the Site are listed in US dollars (USD) unless otherwise indicated. Prices are subject to change without prior notice. Any price change will not affect orders that have already been confirmed.
Order acceptance
Your placement of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order is not confirmed until you receive an order confirmation email from us. We may cancel or limit orders that appear to be placed by resellers or that exceed reasonable personal-use quantities.
Availability
All products are subject to availability. We make every effort to keep our Site inventory accurate, but in rare cases a product may become unavailable after you place an order. If this occurs, we will notify you promptly and offer a full refund or an alternative.
Pre-orders and limited releases
From time to time, we may offer products for pre-order or as limited-edition collaborations. Pre-order products will ship by the estimated date stated at the time of purchase. If there is a significant delay, we will notify you and offer the option to cancel for a full refund. Payment for pre-orders is collected at the time the order is placed unless otherwise stated.
4. Payment
We accept payment through the methods displayed at checkout, which may include credit and debit cards (processed by Stripe), PayPal, Apple Pay, and other payment providers. All payment processing is handled by our third-party payment providers. We do not store your payment card information on our servers.
You agree to provide current, complete, and accurate billing and payment information. If payment cannot be processed, we reserve the right to cancel your order.
All applicable taxes (including sales tax for US orders) will be calculated and displayed at checkout based on your shipping address.
5. Shipping
Domestic shipping (United States)
Orders are typically processed and shipped within 2 business days. Shipping rates and estimated delivery times are displayed at checkout.
Free shipping on US orders over $150.
International shipping
We ship internationally to most countries. Shipping rates and estimated delivery times for international orders are calculated at checkout.
Important: International customers are responsible for all customs duties, import taxes, brokerage fees, and any other charges assessed by their country upon arrival of the shipment. These charges are not included in the product price or shipping cost and are not collected by Nordic Yarn. We have no control over these charges and cannot predict their amount. Please consult your local customs authority for information about duties and taxes applicable to your order.
If you refuse delivery or fail to pay applicable customs charges, resulting in the package being returned to us, you will be refunded the product cost minus the original shipping charge and any return shipping costs incurred by us.
Risk of loss
For domestic orders, risk of loss passes to you upon delivery to your address as confirmed by the carrier’s tracking information. For international orders, risk of loss passes to you when the package is handed over to the international carrier at our shipping facility.
Delivery issues
If your package is lost, damaged, or significantly delayed in transit, please contact us at hello@nordicyarn.com. We will work with the carrier to resolve the issue. For international shipments, please note that customs processing can cause delays beyond our control.
6. Returns and Refunds
We want you to be completely satisfied with your purchase.
Eligible returns
Unused, unwound skeins of yarn in their original condition may be returned within 30 days of delivery for a full refund, less shipping, to your original payment method.
Non-returnable items
The following items cannot be returned: Yarn that has been wound, used, or is not in its original condition, Digital pattern downloads, Gift cards, Sale items (if applicable during designated sale periods), and Custom or special orders.
How to initiate a return
Contact us at hello@nordicyarn.com within 30 days of delivery to arrange your return. Please include your order number. We will provide return shipping instructions. Return shipping costs are the responsibility of the customer unless the return is due to our error (wrong item shipped, defective product).
Refund processing
Refunds are processed within 5 business days of receiving the returned items. Please allow additional time for the refund to appear on your statement, depending on your payment provider.
Exchanges
We do not offer direct exchanges. If you would like a different color or product, please return the original item for a refund and place a new order.
Defective products
If you receive a product that is defective (significant inconsistencies in the yarn, damage not attributable to shipping), please contact us within 14 days of delivery with photos of the issue. We will replace the product or issue a full refund at our discretion, including return shipping costs.
7. Gift Cards
Gift cards purchased from Nordic Yarn do not expire and are not subject to inactivity or service fees. Gift cards are non-refundable and cannot be redeemed for cash except where required by applicable law. Gift cards may only be used for purchases on our Site. Lost or stolen gift cards cannot be replaced.
8. Patterns and Intellectual Property
Pattern license
When you purchase or receive a Nordic Yarn pattern (whether purchased separately, included in a kit, or provided free of charge), you are granted a limited, personal, non-transferable, non-exclusive license to use that pattern for your own personal, non-commercial purposes.
You may: Knit or crochet items from the pattern for yourself or as personal gifts, Sell finished items you have personally made from the pattern in small quantities (e.g., at craft fairs or through personal shops), provided you credit “Pattern by [Designer Name] for Nordic Yarn” in any listing or description.
You may not: Redistribute, share, resell, or publish the pattern in any form (digital or print), Reproduce or distribute the pattern in whole or in part, including through photocopying, screenshot, or file sharing, use the pattern for commercial manufacturing or mass production, Teach the pattern in a class or workshop without prior written permission from Nordic Yarn.
Violation of these terms may result in termination of your license and further action to protect our intellectual property may occur.
Site content and trademarks
All content on the Site, including text, images, photography, graphics, logos, and design, is the property of Nordic Yarn or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Site without our prior written consent.
The Nordic Yarn name, logo, and related marks are trademarks of Nordic Yarn. Use of our trademarks without prior written permission is prohibited.
9. User-Generated Content
Reviews and comments
We may allow you to post reviews, comments, or other content on the Site. By posting content, you represent that it is accurate, that it does not violate these Terms, and that it does not infringe the rights of any third party.
We reserve the right to remove, edit, or decline to publish any user content at our sole discretion, for any reason, without notice.
Social media and submitted content
By tagging Nordic Yarn in social media posts, submitting photos of your projects, or otherwise sharing content with us or about our products, you grant Nordic Yarn a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, display, and distribute that content in connection with our business, including on our Site, social media channels, email marketing, and promotional materials.
We will credit you by name or handle when reasonably practical. If you would like specific content removed, please contact us at hello@nordicyarn.com and we will remove it promptly.
You retain ownership of any content you create. This license does not transfer ownership of your content to us.
10. Privacy
Your use of the Site and any personal information you provide is governed by our Privacy Policy, available at [link to Privacy Policy]. By using the Site and placing an order, you consent to the collection and use of your information as described in the Privacy Policy.
11. Third-Party Links and Services
The Site may contain links to third-party websites, including but not limited to pattern marketplaces, social media platforms, and payment providers. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, privacy practices, or terms of service of any third-party website. Your interactions with third-party sites are governed by their own terms and policies.
12. Disclaimer of Warranties
The Site and all products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components.
We do not make any representations or warranties regarding the results of using our products, including the outcome of any knitting or crochet project.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Nordic Yarn, its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from or related to:
• Your use of or inability to use the Site or our products
• Any errors, inaccuracies, or omissions in Site content
• Unauthorized access to or alteration of your data
• Any third-party conduct on or related to the Site
• Any other matter relating to the Site or our products
In no event shall our total liability to you for all claims arising from or related to the Site or your purchases exceed the total amount you have paid to Nordic Yarn in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Nordic Yarn, its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
15. Dispute Resolution
Informal resolution
Before initiating any formal proceeding, you agree to contact us at hello@nordicyarn.com to attempt to resolve any dispute informally. We will make a good faith effort to resolve any dispute within 30 days of receiving your notice.
Binding arbitration
If a dispute cannot be resolved informally, you and Nordic Yarn agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in the State of New Hampshire unless you and Nordic Yarn agree otherwise, or the AAA rules provide for an alternative location.
The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver
You and Nordic Yarn agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and Nordic Yarn waive any right to a jury trial.
Small claims exception
Notwithstanding the above, either party may bring an individual action in small claims court in the State of New Hampshire if the claim falls within the court’s jurisdictional limits.
Opt-out right
You may opt out of the arbitration and class action waiver provisions by sending written notice to hello@nordicyarn.com within 30 days of your first purchase from Nordic Yarn. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, disputes will be resolved in the state or federal courts located in the State of New Hampshire.
European Union and United Kingdom customers
If you are located in the EU or UK, nothing in this section limits your rights under applicable consumer protection laws, including your right to bring proceedings in the courts of your country of residence. You may also use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Canadian customers
If you are located in Canada, nothing in this section limits your rights under applicable provincial or federal consumer protection legislation.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions, except where overridden by the mandatory consumer protection laws of your country of residence.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Nordic Yarn regarding your use of the Site and your purchases. These Terms supersede any prior agreements, communications, or understandings between you and Nordic Yarn.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
